TERMS OF SERVICE

These Terms and Conditions (“Terms”) govern all services provided by Hammerhead Hydraulics (“we”, “our”, “us”) to our customers (“you”, “your”). By engaging our services, you agree to these Terms.
1. Scope of Services
We provide hydraulic services including hose repairs, fittings, maintenance, custom assemblies, and emergency breakdown support. Specific inclusions will be outlined in our quotes or service agreements.
2. Pricing & Payment
All prices are quoted in Australian dollars (AUD) and are exclusive of GST unless otherwise stated.
Payment is required upon completion of services unless prior arrangements have been agreed.
We reserve the right to charge interest or late fees for overdue accounts.
Call-out fees may apply for mobile servicing and after-hours work.
3. Call-Outs & Cancellations
If you cancel a scheduled service with less than 24 hours’ notice, a cancellation fee may apply.
Emergency breakdown support is subject to availability. While we make every effort to respond quickly, we cannot guarantee specific arrival times.
4. Customer Responsibilities
You must ensure safe access to the worksite and provide accurate information about your machinery and requirements.
We are not liable for delays caused by unsafe or inaccessible work environments.
5. Warranties & Liability
We supply parts and fittings from third-party manufacturers. Any warranties provided are subject to the manufacturer’s terms.
Our workmanship is guaranteed for a period of [insert timeframe, e.g., 90 days] from the date of service.
To the maximum extent permitted by law, we are not liable for:
Pre-existing faults or damage to your equipment
Consequential or indirect losses (e.g., lost revenue due to downtime)
Delays outside of our control (e.g., supply shortages, site inaccessibility)
6. Australian Consumer Law
Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). You are entitled to certain guarantees for goods and services which cannot be excluded.
7. Dispute Resolution
If a dispute arises, both parties agree to first attempt to resolve the matter in good faith. If unresolved, disputes may be referred to mediation before taking legal action.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
9. Changes to Terms
We may update these Terms from time to time. The latest version will always be available on our website or provided upon request.
